How EU Law Could Be Better Enforced - Workshop by the European Parliament's Commitee on Legal Affairs

Prof. Mary-Rose McGuire and Prof. Schulte-Nölke participated in a recent workshop hosted by the European Parliament’s Committee on Legal Affairs (JURI) on 'Monitoring the Application of EU Law.' 

Their presentation focused on the European Comission's 2023 annual report (COM (2024) 358), which details the Commission’s enforcement efforts, primarily concerning Member States’ transposition of Directives. While the report presents a success story, it has limitations – largely reflecting Commission-initiated procedures and lacking transparency regarding cases not pursued, potentially for political reasons, and a robust assessment of data reliability.

They underlined the need for improved tools and independent research to assess the actual impact of EU law, moving beyond simply confirming transposition. This question is the focus of one of the projects run by their institute, the European Legal Studies Institute (ELSI) at the Universität Osnabrück. The project is entitled: Private and Public Law Rights & Remedies - Tools for better enforcement of EU law.

The workshop directly informed the JURI Committee, with the chair Ilhan Kyuchyuk and several members in attendance, and helped prepare the Committee’s response to the Commission Report. The video of the discussion can be viewed on the right.
